Description / Synopsis
For the sake of the campaign, and working under the concept: "Creating wonder out of basics" we recruited the world famous Artist: Piven. Choosing him for the campaign seemed only natural. A perfect fit as his trademark attribute is his ability to turn the tiniest basic things into real works of art.
Context
Piven created 12 new characters made exclusively from a wide range of Strauss company products and brands. While the TV commercials focus on the creative process and showcase Piven's unique way of working complete with dilemmas and all, the print ads present the 12 lovable characters proving wonder can indeed be created from basics.

統一超商於國民便當商品促銷廣告中,商品價格為引人錯誤之表示罰50萬元

行政院公平交易委員會於本(10)日第918次委員會議決議,統一超商股份有限公司於國民便當商品促銷廣告中,就商品之價格為引人錯誤之表示,違反公平交易法第21條第1項規定,依同法第41條規定命其立即停止前述違法行為,並處新臺幣50萬元罰鍰。
公平交易委員會表示,商品價格資訊為影響消費者交易決定之重要判斷依據,事業促銷廣告倘以商品價格為主要訴求,應就價格金額詳實說明,不得有引人錯誤之情事。統一超商公司98年4月8日至21日之國民便當商品促銷活動,為將原價49元2009國民便當排骨飯、2009國民便當雞排飯、第一代國民便當,及原價55元之新國民便當商品,與原價20元之茶裏王商品搭配銷售,消費者合購總價格為59元或65元,與分別單獨購買之價差為10元,並據此換算國民便當價格為39元起。亦即,消費者倘欲購得降價之國民便當,須合購國民便當加茶裏王整組商品,該活動並不提供消費者以39元購買單一品項之國民便當,且該促銷活動消費者實際支應之價格,至少需為59元。然據公平會調查發現,統一超商公司之電視廣告就該項影響消費者交易決定之價格資訊,僅以文字及旁白強調「解除國民便當價格戒嚴令」、「國民便當(只要)39元起」,並無搭配茶裏王商品之合購總價為59元或65元,也就是消費者實際應支付總價格的表示,易使相當數量之一般大眾產生國民便當商品單一品項購買價格即為39元之認知或交易決定,且無法獲知促銷活動應至少支岀59元之訊息,足認統一超商公司之國民便當電視廣告表示有為引人錯誤之情事。

大金空調商品廣告不實罰100萬元

行政院公平交易委員會於98年6月3日第917次委員會議決議,和泰興業股份有限公司(下稱和泰公司)就所代理之大金空調商品,於電視及報紙廣告宣稱「變頻空調 全球第一」、「全球變頻第一」、「DAIKIN在台,變頻連續7年,蟬聯第一」及「全產品日本第一,市佔率超過33%,總噸數日本第一」,就商品之品質為虛偽不實及引人錯誤之表示,違反公平交易法第21條第1項規定。另和泰公司於報紙刊登「日立冷氣 請加油!」廣告,就競爭者商品之品質為足以影響交易秩序之顯失公平行為,違反公平交易法第24條規定,公平會除命其停止前2項違法行為外,並處和泰公司新臺幣100萬元罰鍰。
公平交易委員會指出,和泰公司就所代理之大金空調商品,於電視及報紙廣告宣稱「變頻空調 全球第一」、「全球變頻第一」、「DAIKIN在台,變頻連續7年,蟬聯第一」及「全產品日本第一,市佔率超過33%,總噸數日本第一」等,但並未提出銷售數字或意見調查等客觀數據以資佐證,就商品之品質為虛偽不實及引人錯誤之表示,核已違反公平交易法第21條第1項之規定。另和泰公司於報紙刊登「日立冷氣 請加油!」廣告,雖已載明資料來源且經核與所引據國內外雜誌報導內容相合,惟自廣告整體呈現效果觀之,已足使消費者就其競爭者誤生國內市場銷售排名日降及事業營運不佳、無法存續經營等負面印象,顯係損害特定競爭對手並意圖在整體印象上造成不公平之比較結果,有違公平競爭之商業倫理,足以影響交易秩序,核屬違反公平交易法第24條之顯失公平行為。
