Antonín Leopold Dvořák (September 8, 1841 – May 1, 1904) was a Czech composer of romantic music, who employed the idioms and melodies of the folk music of his native Bohemia and Moravia in symphonic, oratorial, chamber and operatic works.
Symphony No. 9 in E minor, Op. 95, may be better known by its subtitle, From the New World, and is also called the New World Symphony. Dvořák wrote it between January and May 1893, while he was in New York. At the time of its first performance, he claimed that he used elements from American music such as spirituals and Native American music in this work, but he later denied this. The first movement has a solo flute passage reminiscent of "Swing Low, Sweet Chariot", and one of his students later reported that the second movement depicted, programmatically, the sobbing of Hiawatha. The second movement was so reminiscent of a negro spiritual that William Arms Fisher wrote lyrics for it and called it "Goin' Home". Dvořák was interested in indigenous American music, but in an article published in the New York Herald on December 15, 1893, he wrote, "[In the 9th symphony] I have simply written original themes embodying the peculiarities of the Indian music." Neil Armstrong took a recording of the New World Symphony to the Moon during the Apollo 11 mission, the first Moon landing, in 1969.

幾經波折,耗資4億的迪士尼音樂劇「獅子王」即將來台灣演出,地點在台北小巨蛋。可以容納萬人的小巨蛋對於演出「獅子王」是否會造成視線吃力,該製作真正好亞太地區有限公司總監麥克法蘭表示,小巨蛋舞台夠大,也可以讓演員從觀眾席直接演上舞台,到時候現場也會有液晶螢幕讓後排觀眾看個仔細。

「獅子王」從上演到現在,一直是百老匯前五大賣座音樂劇,曾經在1998年獲得東尼獎最佳音樂劇等六大項殊榮,同年獲得葛萊美獎最佳音樂劇專輯,它的音樂充滿非洲大陸壯闊元素,原野般舞台逼真,透過面具跟服裝,讓非洲大陸躍然舞台,帶給觀眾新穎的視覺效果。昨天狒狒女巫也親自著裝到場,一開口就充滿原野般奔放氣息,飾演狒狒女巫的札瑪說,她很喜歡這個角色,透過身上的配件,讓她有預知未來的能力。
【生動面具 串聯故事】
導演茱莉泰默原本是歌劇導演,為了製作「獅子王」,她到印尼親自學習面具製作,把動物放在輪軸之上讓舞者推出來演出,觀眾也可以透過面具知道這個角色的內容,也發掘出了與電影迥異的舞台效果。

China has deployed far more missiles aimed at Taiwan than previously reported, according to U.S. officials with access to intelligence assessments.
The officials say China has 1,400 ballistic missiles targeting the self-governing island over which Beijing claims sovereignty.
That is 40 percent more than earlier U.S. reports saying about 1,000 missiles were deployed across the strait from Taiwan.
The Pentagon, in its recent report on Chinese military power, said 990 to 1,070 missiles were pointed at Taiwan, including variants "with improved ranges, accuracies, and payloads."
President Chen Shui-bian, who is to step down on May 20 when President-elect Ma Ying-jeou is inaugurated, said recently that China had deployed 1,328 missiles at Taiwan.
U.S. officials have declined to confirm Mr. Chen's numbers on the record. But Washington has expressed growing concern over China's military buildup and the threat it poses to Taiwan.
"The threat that China poses is increasing, in my opinion, for the folks who are our friends in Taiwan," Adm. Timothy Keating, the commander of U.S. forces in the Pacific, told Congress earlier this month.
While avoiding discussion of operational plans to respond to the threat, Adm. Keating said his Pacific Command was "adequately resourced" to meet U.S. requirements.

  行政院公平交易委員會於本(28)日第855次委員會議決議,真晶建設股份有限公司(下稱真晶建設公司)於銷售「新第來亨NO.78晴光Diamond」預售屋廣告上,就夾層設計及格局配置為虛偽不實及引人錯誤之表示,違反公平交易法第21條規定,處真晶建設公司新臺幣1000萬元罰鍰,並命該公司立即停止前揭違法行為。另該公司負責人許清芳君多次以不同公司名義推出「新第來亨」系列建案,已13次違反公平交易法相關規定,違法動機屬惡性重大,復依據行政罰法相關規定,處100萬元罰鍰,且該行為是否涉有刑事詐欺責任,該會將一併移送檢警單位偵查
  公平會表示,本案經調查後發現,真晶建設公司於預售「新第來亨NO.78晴光Diamond」建物時,以繪製上、下層圖示之傢俱配置參考圖作為施作夾層設計之說明,足使消費者誤認系爭建築物符合建築相關法令,進而誤認該小坪數所作之夾層設計可達雙倍使用空間;惟本建案未經臺北市建築管理處核准施作夾層,倘擅自增建夾層,將違反建築法相關規定,故真晶建設公司以有夾層設計之廣告作為系爭建案之宣傳方式,使消費者誤認系爭建案所施作之夾層設計為合法,進而認為係以較低價格購買較多坪數而與真晶建設公司進行交易,已違反公平交易法第21條規定。
  公平會進一步表示,真晶建設公司於系爭建案「傢俱配置參考圖」繪有電視櫃、沙發、茶几等圖示,以標示客廳範圍。惟據臺北市政府建築管理處表示,系爭建案「傢俱配置參考圖」與工程第2次變更設計核准平面圖明顯不同,有陽台(雨遮)外推之嫌疑,違反建築法規定,為違章建築。真晶建設公司於傢俱配置參考圖將陽台(雨遮)位置繪製成客廳的一部分,亦足以使一般消費大眾誤認該參考圖所示之客廳範圍均得合法做為客廳使用,屬對商品之內容為虛偽不實及引人錯誤之表示。
  公平會最後表示,被處分人以夾層設計之廣告不實違法行為,使購屋人未來恐因違反建管法令而承受相關處分等不利益,實造成公共安全之疑慮,嚴重損害公共利益,且公司負責人許清芳君多次以不同公司名義推出「新第來亨」系列建案,爰予以重罰。該會呼籲購屋人於購買建案時應特別注意。

獲得全棟公寓住戶同意全權管理頂樓,不代表就能加蓋違建。

林姓男子為獲全棟住戶簽下同意書,取得頂樓管理權,他在頂樓蓋起兩層的樓中樓違建,引發3樓住戶不滿而告上法院,台北地院審理認為,頂樓平台限逃生等功能使用,林某不僅加蓋違建,還蓋2層,不僅遠超出權利範圍也不符合頂樓用途,不具正常性,判他應拆除,林某對此不願回應。
本案原告高某主張,自己住家3樓,雖然早在77年間,就簽同意書,讓4樓的林某全權使用頂樓,但林某卻在頂樓蓋違建,由於是屬於84年前的既存違建,市政府並不會派員拆除,但林某近來卻擴大違建範圍至近40坪,隔了4個房間及樓中樓,阻礙住戶逃生,侵害住戶的頂樓使用權,且水塔也被違建包覆,無法清洗,遂提出告訴。
被告林某主張,自己是獲高某等全棟住戶同意使用頂樓,並出示同意書,林某認為,違建是早就存在,並非近來才搭蓋,且全棟住戶都有通往頂樓的鑰匙,頂樓仍具緊急逃生功能,至於水塔,林某主張,他都有僱工清洗,林某認為,高某提出訴訟,要求他拆屋還頂樓,違反「誠信原則」。
台北地院審理認為,林某的確有頂樓「專用權」,但仍應本於頂樓本來的用途,依頂樓性質、構造使用,法官指出,頂樓平台用途,應是逃生或全體住戶活動之用,林某在頂樓蓋違建,且蓋兩層,已違反頂樓使用目的及專用權範圍,因此判林某應拆除違建。

  行政院公平交易委員會於本(13)日第853次委員會議決議,寶座建設股份有限公司(下稱「寶座公司」)於銷售「花都」建物廣告上,宣稱設置「名流紓壓會館」,就商品之內容為虛偽不實及引人錯誤之表示,違反公平交易法第21條第1項規定,依同法第41條規定,命其立即停止前項違法行為,並處新臺幣150萬元罰鍰。
  公平交易委員會表示,查寶座公司為銷售「花都」建物,於所製作、散發之廣告中宣稱「花都」建物設置內含圖書館、競奕廳、桌球室、撞球室健身院、麻將館、遊藝館、影劇院、童玩場、童書館等設施之「名流紓壓會館」,次查該會館由寶座公司設置於建物地下1樓,並於94年6月間開放予住戶使用,惟據使用執照竣工圖揭示,該會館設置位置用途應為「防空避難室兼汽車停車空間」,且經桃園縣政府認定違反建築法相關規定。按房屋銷售廣告所描述之公共設施情狀,為影響消費者承購與否交易決定之因素,一般消費者據廣告內容僅認知於購屋後得享有廣告所揭示之公共設施,而難以知悉廣告所載之公共設施違反建築法規,縱建商二次施工後,可交付與廣告內容相符之標的物,惟仍有遭建管單位查報拆除等處分之風險,其差距仍難為一般消費大眾所接受。「花都」建物「名流紓壓會館」因係違法設置、使用,建築物所有權人及使用人有遭受罰鍰、停止使用、及強制拆除等處分之風險,是系爭廣告表示之內容與一般消費大眾之認知有相當大之差距,其差距已逾越一般大眾所能接受之程度,且足以引起一般大眾錯誤之認知或決定,爰寶座公司就商品之內容為虛偽不實及引人錯誤之表示,核已違反公平交易法第21條第1項規定。

  公平會表示,依本建案使用執照所載,其基地使用分區為乙種工業區,而建物主要用途為一般商業設施(一般零售業、一般事務所),據臺北縣政府表示,乙種工業區不得為一般住宅使用,作為「住宅」使用者,依法無從辦理變更使用執照,且應依都市計畫法第79條規定處理。準此,故系爭建案依法不得作為住宅使用,惟知森堂公司於本案廣告宣稱「豪宅享受,平價擁有」,並於實品屋為客廳、臥室、廚房及衛浴設備等一般住宅之規劃,足以使人誤認系爭建案可供住宅使用,核屬對於商品之用途為虛偽不實及引人錯誤之表示。
  公平會經審酌知森堂公司違法行為之動機、目的及預期之不當利益;違法行為對交易秩序之危害程度;違法行為危害交易秩序之持續期間;因違法行為所得利益;事業之規模、經營狀況及其市場地位;違法類型曾否經中央主管機關導正或警示;以往違法類型、次數、間隔時間及所受處罰;違法後悛悔實據及配合調查等態度;與其他因素,除命其停止前述違法行為外,並處新臺幣500萬元罰鍰。
